Definitions:
– Seller: Azienda agricola Aurora di Vom Endt Claudia
– Consumer: natural person acting for purposes outside their business, commercial, craft or professional activity.
– Professional: natural or legal person engaging in business, commercial, craft or professional activity.
– Client(s): adult consumer and/or professional purchasing goods. These GTC apply equally to both.

These General Terms and Conditions of Sale govern the retail sale of extra virgin olive oil produced by Azienda agricola Aurora.
The display of products on the website does not constitute a legally binding offer but only a free online catalogue.
By clicking the “submit order” button, the sales contract for the selected items in the cart is concluded. The order confirmation is issued together with the acceptance of the order immediately after the order is placed and will be sent to the purchaser by email. With this confirmation, the purchase contract is considered concluded.

Deliveries are possible both within Italy and abroad.
Shipping costs are borne by the Client and will be specified during the purchase procedure.
Delivery of products will take place within a maximum of 30 days (for deliveries in Italy and Europe); within 45 days for non-EU deliveries, or in any case as soon as possible.

For non-EU shipments, the customs documents required by law (forms CN22 and CN23) will be attached.
The purchaser may add optional insurance at the time of shipment creation, at a variable cost depending on the selected courier and the value of the goods to be insured.
In case of damage, the method of intervention depends on the presence or absence of insurance. In any case, the purchaser must immediately contest the damage at the time of receipt, with a written and signed reservation.

In exceptional cases, the Seller reserves the right (e.g. lack of availability of goods) to terminate the contract. In such cases, the purchaser will be informed immediately, and alternatives may be proposed.

Payment can be made using cards accepted by the SumUp network: Visa, Mastercard, American Express; or via PayPal.

5) Invoicing

At the Client’s request, an invoice will be issued at the time of purchase (sent by email or available online).
The Client must provide the correct details required for the issuance of the invoice when placing the order.

6) Conditions and right of withdrawal

The contract concluded between Azienda agricola Aurora di Vom Endt Claudia and the Client is considered completed upon acceptance of the order by the Seller. This acceptance is tacit unless otherwise communicated to the Client.
By placing an order, the Client declares to be of legal age, to have read all the information provided during the purchase process, and to fully accept the following terms and conditions of sale and payment.

All prices shown on the website are retail prices. Azienda agricola Aurora di Vom Endt Claudia reserves the right to change prices at any time without notice.

Right of withdrawal: The purchaser has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires 14 days from the day the purchaser acquires physical possession of the goods.
To exercise the right of withdrawal, the purchaser must inform the Seller of the decision to withdraw by means of an explicit declaration sent to the email address tenutaaurora@gmail.com.
The costs of returning the goods are to be borne by the Client.

Since this concerns the sale of perishable products, the right of withdrawal is excluded under Art. 59 of the Consumer Code if the seal has been removed after delivery.

7) Legal warranty

The legal warranty lasts two years from the delivery of the goods and must be invoked by the consumer within two months of discovering the defect. Proof of purchase must always be kept.
The warranty period is one year for purchases made by professionals (as indicated by invoices issued to a VAT number), applicable under B2B rules according to the Civil Code. Consumers benefit from the two-year legal warranty, starting from the delivery date, regardless of whether an invoice was issued in their name.

8) Dispute resolution and competent court

These General Terms and Conditions of Sale are subject to Italian law.
The mandatory territorial jurisdiction lies with the court of the consumer’s place of residence or domicile, if located in Italy.
Alternatively, disputes arising from this contract may be settled through alternative dispute resolution procedures with accredited mediation bodies.

9) Language

On the website www.tenutaaurora.it, contracts can only be concluded in Italian.

10) Amendments to the conditions

Azienda agricola Aurora reserves the right to amend the website and these General Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory requirements.
The Client will be subject to the policies and terms in force at the time of ordering, unless modifications are required by applicable law or competent authorities (in which case, such changes shall also apply to previous orders).

If any provision of these GTC is held wholly or partly invalid, void and/or unenforceable, the remaining provisions shall remain valid and effective in any case.

11) Applicable law

The contract is governed by these General Terms and Conditions of Sale as well as, where applicable, by the provisions of Legislative Decree No. 206 of 6 September 2005 (Consumer Code) as amended, and by Legislative Decree No. 70/2003 on electronic commerce, as applicable, as well as by the provisions of the Italian Civil Code for matters not expressly provided herein.
